This document establishes the general Terms and Conditions that will regulate the relationship that arises between Perenne Servicios S.A.S, identified with NIT 901.890.087-6 (hereinafter "Perenne") and the Users, on the occasion of the use by the Users of any of the services that Perenne provides or will provide through its website. https://casasenvilladeleyva.com/ or through any application or technological tool that it enables or develops in the future (the "Platform"). Only persons over 18 years of age may register on the Platform and purchase the products and services offered by Perenne.

Please read these Terms and Conditions carefully together with our Personal Data Processing Policy before contracting any of our services and/or registering on the Platform, as well as before performing any kind of electronic transaction through the Platform. 

By using the Platform, the User is indicating his or her express and unconditional acceptance of these Terms and Conditions and the Personal Data Processing Policy. If the User does not agree with the contents of these documents, he/she should not use the Platform or any of the services offered by Perenne

Perenne will update the Platform from time to time in order to present to Users the properties that are actively available to Users. For this reason, Perenne may modify the properties displayed on the Platform at any time, without incurring any liability towards the Users for this reason. The User declares that he/she will verify the information of the available properties with respect to their conditions of use, content, warnings and, in general, all the information found on the Platform prior to their acquisition.

Clause One. Nature of the service: 

1.1 Perenne allows Users to reserve Tourist Accommodations and Tourist Accommodation Facilities for the enjoyment of themselves and their family members. The properties subject to reservation are owned by third parties (hereinafter "Third Party Owners"), with whom Perenne has entered into mandate agreements. For all purposes, Perenne will act as Host of the Service, in the name and on behalf of each of the Third Party Owners.  

1.2 By virtue of the foregoing, Perenne provides a facilitation service, through which it offers the properties of the Third Party Owners, under the conditions and under the characteristics mentioned for each property.  

1.3 Each of the properties offered by Perenne has an individual tourism register, which is made available to Users on our website: https://casasenvilladeleyva.com/

Clause Two. Procedure for making a reservation: 

2.1 The Platform will allow the User to know the portfolio of properties offered for tourist accommodation. For each property, Perenne will present (i) photographs of the property; (ii) the maximum occupancy capacity; (iii) the municipality in which it is located; and (iv) information regarding the particular characteristics of the property. The above information will allow Users to have a clear, precise, suitable and informed notion of the property in which they are interested. 

2.2 Once the User has noticed a property that is of interest to him/her (hereinafter the "Property"), he/she should contact Perenne through the information channels provided on the website. As soon as possible, Perenne will respond to the User, informing him of: (i) the availability of the Property for the dates requested by the User; and (ii) the total price that the User would pay if he decides to stay at the Property.

Only persons over 18 years of age may register on the Platform and purchase the products and services offered by Perenne.

Perenne will update the Platform from time to time in order to present to Users the properties that are actively available to Users. For this reason, Perenne may modify the properties displayed on the Platform at any time, without incurring any liability towards the Users for this reason. The User declares that he/she will verify the information of the available properties with respect to their conditions of use, content, warnings and, in general, all the information found on the Platform prior to their acquisition.

Clause Three. Accommodation Rules: 

3.1 Special property rules, if any, will be informed by Perenne prior to the execution of the Reservation. However, the following rules apply to all accommodations offered by Perenne

A. Check in time will correspond to 3:00 p.m. 

B. Check out time will be at 12:00 noon. 

C. No party execution is permitted within the properties. 

D. The Property, furniture and other objects made available to the Users for their benefit, must be returned by the User in the same conditions in which they were delivered. The theft of televisions, tables, armchairs, recreational games, sound equipment, furniture, household appliances, towels, sheets, mattresses or any other type of object found in the facilities of the property is strictly forbidden. 

E. The User undertakes to compensate Perenne and the Third Party Owners for any damage that the User and/or his companions may cause to the property and/or to the objects contained therein. For this purpose, the User will pay the cost of the objects that he or his companions have damaged and/or deteriorated, according to the quotation submitted by Perenne. The User must pay for the damaged object within a period not exceeding five (5) days. This obligation constitutes an enforceable title for all legal purposes.  

F. Under no circumstances is underage sex tourism permitted on any of the properties managed by Perenne. Anything that could be classified as child sex tourism may be reported to the authorities by Perenne or the Third Party Owners

G. Users will not be allowed to enter the Properties more people than each property has capacity for. Only persons previously informed by the User to Perenne will be authorized to enter.  

Clause Four. Consent to Purchase, Data Request and Purchase Process: 

4.1. The User's consent is expressed by following the purchase steps established by Perenne, in accordance with the provisions of the second clause above.

4.2. Price and payments: The user at the moment of finalizing the purchase process will be informed of the total price to be paid for the selected accommodation. 

The User understands that the use of credit or debit cards may result in the charging of fees set by the card issuing bank, which do not generate any benefit for Perenne.

Clause Five. Performance of the Hosting Service: 

5.1. Once the payment has been verified, the User must go on the date and time indicated to take the respective property. The decision of not attending the property by the User or his/her companions shall not give the User any right to demand the reimbursement of his/her money, without detriment to the right of withdrawal referred to in clause Six of these Terms and Conditions.

5.2. During the course of the stay, Perenne will answer all questions and requirements that the User may have. Likewise, it will carry out all actions within its reach to guarantee the adequate provision of the lodging service. All queries, requirements and requests will be answered by Perenne through the following number: +573152309335. 

5.3. In any case, the User shall be liable, and shall hold Perenne and the Third Party Owners harmless, if: (i) he wrongly completes the data necessary for the provision of the classes such as his contact details and/or (ii) he does not show up on the informed date and time on which the respective accommodation will take place. 

5.4. The Users, at the time of choosing to reserve one of the properties, acknowledge and accept the condominium rules and regulations that may apply to such properties. To this effect, Perenne will provide such rules and regulations prior to the Guest's arrival. The Guest acknowledges and agrees that he/she shall not do so if he/she does not agree with the rules and regulations or does not comply with the particular conditions thereof. Please consult the above policies and conditions directly with each Allied Establishment. 

Clause Six. Right of Retraction and Reversion of Payment: 

6.1 Right of Withdrawal. In accordance with the provisions of Article 47 of the Consumer Statute, the User shall have a maximum period of five (5) business days to exercise the right of withdrawal, counted from the time the respective reservation is made. For the exercise of this right, the buyer understands and accepts that:

- Any costs that may be generated by the return of the money shall be borne by the user.

- In case of compliance with the provisions of the above points and as defined in Article 47 of Law 1480 of 2011, Perenne will proceed to reverse the transaction.

6.2. Reversal of payment. In accordance with Decree 587 of 2016, the buyer shall be entitled to the reversal of the payment made when: (i) it is subject to fraud; (ii) corresponds to an unsolicited transaction; (iii) the service purchased is not received for a cause not attributable to the User; (iv) the product delivered does not correspond to what was requested, does not comply with the inherent characteristics or those attributed by the information provided about it; and (v) the product delivered is defective.

6.3. In any of the above cases, the User must submit the corresponding complaint to the Perenne hotline, within five (5) business days following the date on which he/she became aware of the fraudulent or unsolicited transaction, or when he/she should have received the service or received it defective or not corresponding to what was requested, explaining the basis and grounds for his/her complaint. Within the same period, the User must inform the issuer of the electronic payment instrument used to make the purchase of the intention to reverse the payment, attaching the supports of the communication sent to Perenne.

Clause Seven. Termination or Modification by Perennial's Decision:

The User understands and agrees that, at any time and without notice, with or without cause, Perenne may suspend, modify or alter any aspect, function or policy of the Platform. 

Clause Eight. Prohibited Conduct for the User: 

8.1. Without limiting the prohibitions and restrictions found elsewhere in the Terms and Conditions, the User agrees not to engage in any of the conduct described below:

- Harass, threaten, stalk, harass, disrupt or defraud users, members or staff of Perenne or the Third Party Owners or any other person, or create or contribute to an unsafe, harassing, threatening or disruptive environment;

- Acting in a deceptive or fraudulent manner by, among other things, impersonating another person or accessing another user's account or registering for more than one account;

- Sharing Perenne passwords with third parties or encouraging any other user to do so;

- Allow any person to use any class or service reserved under their own membership, including other members;

- Engage in any conduct that infringes the intellectual property rights of Perenne or the Third Party Owners;

- Upload harmful material such as viruses that affect the computer systems or data of Perenne or users of the Site, or otherwise use the Platform in any manner that could damage, disable, overburden, or impair the Platform or interfere with any other party's use and enjoyment of the Site;

- Upload or send to users of the site pornographic, threatening, embarrassing, hateful, racially or ethnically insulting, libelous or inappropriate content;

- Decompile, reverse engineer or disassemble the Site, in whole or in part, except as permitted by applicable law;

- Modify the Site in any way, shape or form, or use modified versions of the Site, including (without limitation) for the purpose of obtaining unauthorized access to the Site;

- Use the Platform for any purpose that is unlawful or prohibited by these Terms and Conditions.

Perenne reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

Clause Nine. Failures in the System: 

Perenne will not be liable for any damage or loss caused to the User by system, server or Internet failures. Nor shall Perenne be liable for any viruses that may infect the User's computer equipment as a result of accessing, using or examining the Web Site or as a result of any transfer of data, files, images, text, or audio contained therein.

Perenne does not guarantee continuous or uninterrupted access to and use of its site. The system may eventually be unavailable due to technical difficulties or Internet failures, or due to any other circumstance beyond Perenne's control; in such cases Perenne will try to restore it as quickly as possible without any liability on its part.

Tenth Clause. Authorization for the Collection of Personal Data: 

10.1. By accepting these Terms and Conditions, the User indicates that he/she has been informed that he/she is aware of and accepts Perenne's Personal Data Processing Policy, available on the Platform. 

10.2. Consequently, by accepting these Terms and Conditions, the user indicates that he/she previously, expressly and informedly authorizes Perenne to process his/her personal data in the transactions that are executed through the Platform; he/she also authorizes Perenne to collect, store and process his/her personal data for commercial and promotional activities and other purposes indicated in Perenne's Policy for the Processing of Personal Data.

Perenne will be responsible for the processing and security of personal data provided by Users, in compliance with Law 1581 of 2012, Decree 1377 of 2013 and Perenne's Personal Data Processing Policy.

Clause Eleven. Authorization for the Transfer of Personal Data:

11.1. By accepting these Terms and Conditions, the user also expressly, previously and informedly accepts and authorizes Perenne to transfer his or her personal data to the Third Party Owners. 

11.2. In such circumstances, the Third Party Owner will be responsible for the processing of personal data provided by Users for the proper provision of the contracted classes, in compliance with Law 1581 of 2012, Decree 1377 of 2013 and the Privacy Policy of the respective Third Party Owner. The Users accept and know that the Third Party Owners will not have access to the data of the means of payment used by the Users on the Platform. 

Clause Twelve Two. Origin of resources:

12.1 The User declares under oath that his/her income comes from lawful activities, that he/she is not registered in the databases related to money laundering or financing of terrorism, and that in no way is using the means provided by Perennec asinstruments for the concealment, management, investment or use in any form of money or other assets derived from criminal activities, or to give the appearance of legality to these activities.

12.2. In this regard, if deemed necessary, the Companies may use Money Laundering and Terrorist Financing Risk Management Systems (SARLAFT). Violation of this obligation shall entitle Perenne to demand compensation for any damage suffered by the Company through legal mechanisms.

Thirteenth Clause. Intellectual Property: 

Perenne reserves all rights, including intellectual and industrial property rights, associated with Perenne's services, its websites, the contents of its screens, programs, databases, networks, codes, development, software, architecture, hardware, contents, information, technology, integration phases, functionalities, domains, trademarks, patents, copyrights, industrial designs and models, trade names, among others, and declares that they are protected by national and international laws in force.

Under no circumstances shall it be understood that the User shall have any rights over them except to use the Platform service in accordance with the provisions of these Terms and Conditions. The improper use or use contrary to the regulations in force of Perenne's intellectual and industrial property rights, as well as their total or partial reproduction, is prohibited, unless expressly authorized in writing by Perenne.

13.3. The Site may contain links to third party web sites. Since Perenne has no control over such sites, Perenne shall not be responsible for the contents, materials, actions and/or services provided by such sites, nor for any damage or loss caused directly or indirectly by the use of such sites. The presence of links to other websites does not imply a partnership, relationship, approval, or endorsement by Perenne of such sites and their contents.

Clause Fourteen. Attention to Claims: 

14.1 In case of any doubt about the content or interpretation of these Terms and Conditions or in case of difficulties in the use of the Platform, you should contact Perenne through its customer service line: +3152309335. Depending on the complexity of the concern presented, they may provide an immediate solution or refer your question to the area in charge. In the latter case, an authorized Perenne representative will contact the User to resolve his concerns. 

14.2. The User may also write to the e-mail address alejandra@casasenvilladeleyva.com where he/she should include his/her personal and contact details required for the processing and solution of the consultation, together with his/her doubt or concern, about which he/she will receive an e-mail reply. The response time by Perenne will be fifteen (15) working days.

Clause Fifteenth. Modification of the Terms and Conditions: 

As Perenne is constantly working to improve the provision of its services, it may update and/or modify these Terms and Conditions from time to time. When this happens, Perenne will send a notification to the Users so that they can consult the updates and/or modifications prior to their coming into force. If the User continues to use the Platform or our services after the updates or modifications have become effective, the User will be deemed to have accepted such updates or modifications. 

16.1 This agreement shall be governed in all respects by the laws in force in the Republic of Colombia.
